1. Acceptance of Terms, Definitions & Scope
Welcome to byryembroidery ("byryembroidery," "we," "our," or "us"). These Terms & Conditions ("Terms") govern your access to and use of our website, services, products, and custom embroidery services.
By accessing our website, requesting a quote, submitting an inquiry, approving a design proof, placing an order, or otherwise purchasing from byryembroidery, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to these Terms, you should not use our website or purchase our products or services.
These Terms apply to all customers, visitors, purchasers, and users of our website and services.
About byryembroidery
byryembroidery is a Massachusetts sole proprietorship specializing in custom machine embroidery. Every order is individually prepared, digitized when necessary, stitched, inspected, and packaged by a single owner and operator. Because each item is produced individually, no two embroidered products will be identical.
Slight differences in embroidery placement, stitch density, thread appearance, fabric behavior, and finished products are considered normal characteristics of custom embroidery and are not defects.
Definitions
- Business refers to byryembroidery.
- Customer refers to any individual or organization requesting a quote, placing an order, purchasing products, or otherwise using our services.
- Custom Product means any item produced specifically for a customer, including personalized names, initials, monograms, logos, artwork, digitized embroidery files, or any made-to-order embroidery.
- Customer-Supplied Item means any garment, accessory, fabric, or other item provided by the customer for embroidery.
- Proof means a digital mock-up, embroidery preview, stitch simulation, sample image, or other representation of the proposed design sent to the customer for approval before production begins.
- Production begins when the customer has approved the proof (when applicable) and submitted full payment. Once production begins, the order enters our embroidery workflow and materials, machine time, and labor are committed to that order.
- Rush Order means any order requested on an expedited timeline that requires prioritization over existing production. Rush availability is not guaranteed and is accepted solely at the discretion of byryembroidery. Rush fees begin at $25 and may increase based on order size, complexity, or turnaround requirements.
Changes to These Terms
We reserve the right to modify these Terms at any time to reflect changes in our business operations, legal requirements, products, or services. Any updates become effective immediately upon posting to our website unless otherwise stated. Orders already accepted prior to a revision will generally be governed by the version of the Terms that was in effect when the order was placed, unless required otherwise by applicable law.
Additional Policies
These Terms work together with our other published policies, including our Privacy Policy. In the event of any conflict between these Terms and a separate written agreement signed by both parties, the signed written agreement will control for that specific order.
Electronic Communications
By contacting byryembroidery through our website, email, social media, or any other electronic method, you consent to receive communications electronically regarding your inquiry or order. These communications may include quotes, design proofs, order updates, shipping notifications, responses to customer inquiries, and requests for additional information needed to complete your order.
Because byryembroidery does not currently operate a marketing email program, your contact information will not be used to send promotional or advertising emails unless you separately opt into such communications in the future.
Entire Agreement
These Terms constitute the primary agreement governing purchases from byryembroidery and apply to all custom embroidery services unless superseded by a separate written agreement signed by both the customer and byryembroidery.
2. Eligibility, Ordering Process & Quotes
Eligibility to Place an Order
By placing an order with byryembroidery, you represent and warrant that you are at least eighteen (18) years of age, or you have the permission of a parent or legal guardian; you have the legal authority to enter into a binding agreement; all information you provide to us is accurate, complete, and current; you are authorized to submit any artwork, logos, text, or designs you provide for embroidery; and you agree to comply with these Terms and all other applicable policies.
We reserve the right to refuse service or cancel an order if we believe false or misleading information has been provided.
How the Ordering Process Works
Step 1 — Inquiry. Customers begin by submitting an inquiry through our website or by contacting us directly. We may request information including the item(s) to be embroidered, garment color and size, desired embroidery placement, quantity, thread colors, artwork or inspiration images, personalization details, desired completion date, and whether you are a returning customer. Submitting an inquiry does not guarantee acceptance of your order.
Step 2 — Quote. After reviewing your request, we will provide a quote, which may include product cost, embroidery cost, digitizing fee (if applicable), rush order fee (if applicable), shipping charges, and applicable taxes. Unless otherwise stated, quotes are valid for 14 calendar days, and may change after expiration due to changes in material costs, supplier pricing, shipping costs, or requested project modifications.
Step 3 — Artwork Review. Before production begins, we review all submitted artwork and may request higher-resolution files, vector artwork, additional design clarification, different fonts, color adjustments, or simplification of artwork that cannot be embroidered successfully. Not every digital image can be embroidered exactly as shown — very small lettering, intricate gradients, photographic images, and extremely detailed graphics may require modifications to produce a high-quality embroidered result. byryembroidery reserves the right to recommend changes that improve stitch quality and durability.
Step 4 — Proof Creation. When applicable, customers will receive a digital proof within approximately 1–3 business days after we've received all necessary information. Proofs demonstrate design layout, placement, thread color selection, personalization, and approximate sizing. Digital proofs are approximations — actual embroidered products may vary slightly due to fabric type, garment construction, thread sheen, stitch direction, machine tension, hoop placement, and stabilization methods. These normal variations are not considered defects.
Step 5 — Customer Approval. Production will not begin until the customer approves the proof (when applicable) and full payment has been received. Approval confirms that the customer has reviewed and accepted names, spelling, dates, initials, fonts, colors, placement, design size, and overall appearance. Customers are solely responsible for reviewing their proof carefully. byryembroidery is not responsible for errors that were present on an approved proof.
Step 6 — Production. Production begins only after proof approval and full payment. Our standard production timeline is approximately 2 weeks, give or take, depending on order complexity, size, and volume already in the queue. Production timelines are estimates and may vary depending on order volume, project complexity, product availability, machine maintenance, holidays, or shipping delays outside our control. Estimated completion dates are not guaranteed unless confirmed in writing.
Changes After Approval
Once a proof has been approved and production has begun, design, personalization, font, thread color, and placement changes are not permitted, and order cancellations are not permitted except as required by law. If production has not yet begun, requested changes may be accommodated at our discretion and may result in additional charges or production delays.
Rush Orders
Rush production is offered only when our schedule permits. Rush service begins at $25, may increase depending on complexity or quantity, does not guarantee carrier delivery times, and is subject to available production capacity. Acceptance of a rush order is entirely at the discretion of byryembroidery.
Right to Refuse Orders
byryembroidery reserves the right to decline or cancel any inquiry or order for any lawful reason, including incomplete order information, inability to meet requested deadlines, designs that cannot be embroidered successfully, suspected fraud, offensive or unlawful content, excessive revisions beyond the original project scope, abusive or harassing customer conduct, or requests that could damage equipment or compromise product quality. If an order is declined before production begins, any payment received will be refunded in accordance with our Return & Refund policy below.
Good Faith Collaboration
Custom embroidery is a collaborative process. By placing an order, the customer agrees to communicate promptly, provide accurate information, review proofs carefully, and respond within a reasonable timeframe to avoid unnecessary delays. Likewise, byryembroidery is committed to communicating clearly, producing each order with care, and making reasonable efforts to meet estimated production timelines while maintaining quality standards.
3. Pricing, Payment & Fees
Pricing Philosophy
Every order placed with byryembroidery is individually quoted based on the unique requirements of the project. Custom embroidery requires individualized design preparation, machine setup, stabilizer selection, thread selection, production time, quality inspection, and packaging — so prices may vary between projects, even when products appear similar. Unless otherwise stated in writing, all prices are quoted in U.S. Dollars (USD).
What Determines Pricing
Pricing may include the blank garment or product cost, embroidery labor, stitch count and design complexity, design sizing, quantity ordered, thread color changes, digitizing or artwork preparation, specialty materials, rush production fees, shipping and handling, and applicable sales tax where required by law. Quotes are prepared based on the information provided by the customer; if project details change after a quote has been issued, pricing may be adjusted accordingly.
Quote Validity
Unless otherwise specified in writing, quotes remain valid for 14 calendar days from the date issued. After this period, prices may change due to supplier price increases, material availability, shipping cost fluctuations, labor requirements, or changes requested by the customer. byryembroidery is not obligated to honor expired quotes.
Full Payment Requirement
Because every project is custom-made, full payment is required before production begins. Production will not be scheduled until payment has been successfully received. Orders that remain unpaid may be delayed or canceled without notice. No materials will be ordered, no digitizing will begin, and no embroidery work will commence until payment has cleared.
Accepted Payment Methods
At this time, byryembroidery accepts payment through Venmo. Additional payment methods may be added in the future and will be listed on our website. Customers are responsible for ensuring payment is submitted using the correct account information.
Payment Timing
Payment becomes due once the project details have been finalized, a quote has been accepted by the customer, and a proof has been reviewed, if applicable. Production begins only after full payment has been received and proof approval has been provided (when applicable).
Non-Payment
If payment is not received, production will not begin, production timelines will not be reserved, estimated completion dates may change, quotes may expire, and inventory availability cannot be guaranteed. Repeated failure to complete payment may result in future orders being declined.
Additional Charges
Additional fees may apply if the customer requests changes after a quote has been prepared but before production begins — for example, changing garment types, adding personalization, changing embroidery locations, increasing quantities, modifying artwork, requesting additional proofs, resizing designs, or converting low-quality artwork into embroidery-ready files. Any additional charges will be communicated before work proceeds.
Digitizing Fees
Certain designs require professional digitizing before they can be embroidered. Digitizing is a separate service from embroidery and compensates for the time required to create a stitch file that produces a high-quality embroidered result. Unless otherwise agreed in writing, digitizing fees are charged once for the initial creation of a design; future modifications to an existing design may incur additional digitizing charges; and digitizing fees are non-refundable, even if the customer chooses not to proceed with embroidery after the file has been created.
Ownership of Digitized Files
Unless otherwise agreed in writing, the customer purchases the embroidered product — not the underlying embroidery file. All digitized embroidery files created by byryembroidery remain the exclusive intellectual property of byryembroidery. Digitized files will not be provided, transferred, sold, or licensed to customers unless a separate written agreement expressly states otherwise. This allows byryembroidery to maintain quality control and protect the time and expertise invested in creating custom embroidery files.
Rush Order Fees
Rush production is offered when scheduling permits. Rush service starts at $25 and may increase depending on order complexity, quantity, production schedule, or requested turnaround time, and does not guarantee carrier delivery times. Rush fees compensate for prioritizing production ahead of previously scheduled work and are non-refundable once production has begun.
Shipping Charges
Shipping charges are calculated separately unless otherwise stated. Customers are responsible for shipping costs, any optional shipping upgrades, and additional delivery services requested by the customer. Shipping charges are not included in product pricing unless specifically stated.
Taxes
Applicable sales tax will be collected when required under Massachusetts law or other applicable tax regulations. Customers remain responsible for any taxes required by law.
Pricing Errors
Although every effort is made to ensure accurate pricing, errors may occasionally occur. If an obvious pricing mistake is discovered before production begins, byryembroidery reserves the right to correct the error, cancel the order, or offer the customer the opportunity to proceed at the correct price. If the customer chooses not to proceed, any payment already received will be refunded in full.
Chargebacks & Payment Disputes
Customers agree to contact byryembroidery directly before initiating a payment dispute or chargeback whenever possible. If a payment dispute is filed after work has begun, byryembroidery reserves the right to provide documentation supporting the order, including approved proofs, written communications, invoices, payment confirmations, production records, shipping records, and delivery confirmations. Submitting false or fraudulent payment disputes may result in refusal of future service and any other remedies available under applicable law.
Fair Pricing Commitment
byryembroidery is committed to transparent, honest pricing. Every order is quoted individually to reflect the true scope of the project, ensuring customers pay only for the services and materials required for their specific order. No hidden fees will be added after a quote has been accepted unless the customer requests changes or additional services.
4. Design Proofs, Production Standards & Customer Responsibilities
Our Commitment to Quality
At byryembroidery, every order is individually produced by a single embroiderer using commercial embroidery techniques, quality materials, and careful attention to detail. Because every item is stitched individually, slight variations are a natural part of the embroidery process and contribute to the uniqueness of each finished product.
Design Proof Process
For most custom orders, customers will receive a digital proof before production begins, generally delivered within 1–3 business days after we have received complete order details, any required artwork, product information, and all necessary clarification from the customer. Production timelines do not begin until the proof has been approved and full payment has been received.
Purpose of the Proof
The proof is provided so the customer can verify the overall design before embroidery begins. Customers are responsible for reviewing spelling, grammar, initials, names, dates, placement, thread colors, font selection, design size, and overall layout. Approval confirms that all information is correct.
Final Approval
Production begins only after the customer provides written approval of the proof, which may be given through email, website communication, or other written electronic communication accepted by byryembroidery. Once approval has been received, the design is considered final.
No Changes After Approval
Once production has begun, names, initials, dates, fonts, colors, placement, garment selection, design size, personalization, and artwork cannot be changed. This policy exists because embroidery production involves machine setup, stabilization, thread preparation, and irreversible stitching. If a customer requests changes before production begins, additional charges and production delays may apply.
Production Timeline
Standard production is approximately 2 weeks, give or take, depending on order complexity, size, and volume already in the queue, beginning only after full payment has been received and the proof has been approved. Estimated timelines are not guarantees — production schedules may be affected by order volume, material availability, supplier delays, equipment maintenance, severe weather, holidays, shipping carrier interruptions, or other events beyond our reasonable control. We will make reasonable efforts to notify customers of significant delays whenever possible.
Rush Production
Rush production may be available depending on our current workload. Rush service starts at $25, is subject to scheduling availability, may require additional fees for larger or more complex orders, and does not guarantee shipping carrier delivery dates. Acceptance of a rush order remains solely at the discretion of byryembroidery.
Embroidery Limitations
Embroidery is a stitched medium rather than a printed medium. Certain artwork — extremely small lettering, thin script fonts, fine line artwork, photographs, gradients, highly detailed illustrations, or designs with excessive stitch density — may require modifications to produce the highest quality embroidered result. When necessary, we may recommend adjustments to improve durability, readability, and stitch quality.
Color, Placement & Size Variations
While every effort is made to match requested thread colors, exact color matching cannot be guaranteed due to thread manufacturer dye lots, fabric color and texture, lighting, and monitor or mobile device display settings. Minor color differences are normal and are not considered defects. Because each garment is individually hooped and garments vary slightly in construction, size, and fabric characteristics, embroidery placement may also differ slightly between items — minor placement differences are normal and are not grounds for replacement or refund. byryembroidery reserves the right to make minor adjustments necessary to achieve the best possible finished product while maintaining the overall appearance of the approved design.
Thread & Material Substitutions
Occasionally, specific thread colors or stabilizing materials may become unavailable. When this occurs, byryembroidery reserves the right to substitute materials of equal or greater quality that closely match the approved design, without materially altering the overall appearance of the finished product.
Customer Responsibilities
Customers agree to provide accurate spelling and personalization, submit high-quality artwork whenever possible, respond promptly to requests for clarification, review proofs carefully, approve proofs only after confirming all details, and understand the inherent characteristics of embroidery. Delays in customer communication may extend production timelines.
Delayed Customer Responses
If byryembroidery is waiting for customer approval, artwork, clarification, or additional information, production timelines are automatically paused. byryembroidery is not responsible for delays resulting from late responses, missing artwork, incomplete order information, or failure to approve proofs in a timely manner. Production resumes once all required information has been received.
Quality Inspection
Every completed order undergoes a final inspection before shipment, including thread trimming, design verification, placement review, product cleanliness, and packaging preparation. Although every effort is made to identify any issues before shipment, customers should inspect their order promptly upon delivery and notify us if they believe an error occurred.
Handmade Nature of Custom Embroidery
Customers acknowledge that custom embroidery is a handcrafted process. Minor differences between digital proofs, previous orders, online photographs, social media images, and finished embroidered products are expected and reflect the unique nature of individually produced embroidered goods, and do not constitute manufacturing defects.
Professional Standard of Care
byryembroidery is committed to producing every order with the same level of care, craftsmanship, and attention to detail that we would expect when creating products for our own family and friends. While perfection cannot be guaranteed in any handcrafted process, we strive to deliver work that meets high professional embroidery standards.
5. Customer-Supplied Items, Garments & Materials
Customer-Supplied Items
byryembroidery welcomes the opportunity to embroider garments and other items supplied by customers. While this allows customers greater flexibility in selecting brands, colors, and styles, embroidery on customer-supplied items involves additional risks that are not present when products are sourced directly through byryembroidery. By submitting your own item for embroidery, you acknowledge and accept the terms outlined in this section.
Customer Responsibility for Item Selection
Customers are solely responsible for selecting and purchasing any item they provide for embroidery, including verifying fabric composition, size, color, style, brand, intended embroidery location, and suitability for embroidery. byryembroidery is not responsible for sizing issues, color discrepancies, manufacturing defects, or dissatisfaction with a customer-selected product.
Required Product Link
When providing your own garment or product, customers must provide the original product link or retailer listing from which the item was purchased. This allows byryembroidery to verify the exact product, review fabric composition, evaluate embroidery suitability, determine replacement cost if necessary, and identify manufacturer specifications. Failure to provide an accurate product link may limit our ability to replace the item if replacement becomes necessary under these Terms.
Inspection & Suitability
Upon receipt, customer-supplied items may be inspected for obvious defects such as holes, stains, loose stitching, fabric damage, or manufacturing irregularities — though inspection does not guarantee that hidden defects will be discovered before embroidery begins. Not every garment is appropriate for embroidery: extremely lightweight or delicate fabrics, highly elastic materials, waterproof coatings, heat-sensitive materials, and garments with concealed seams or structural limitations may present elevated risk. If byryembroidery determines that an item presents an unreasonable risk of damage or poor embroidery quality, we reserve the right to decline the project before production begins.
Customer Assumption of Ordinary Risks
Embroidery is a mechanical process involving needles, thread, stabilizers, tension, and hooping pressure. By providing your own item, you acknowledge and accept that certain normal characteristics of embroidery may occur, including temporary hoop marks, minor fabric compression, slight puckering on certain fabrics, minor placement variations, and small impressions that typically disappear after washing or steaming. These characteristics are considered normal aspects of embroidery and are not considered damage or defects.
Pre-Existing Garment Defects
byryembroidery is not responsible for damage resulting from weak or worn fabric, manufacturing defects, loose stitching, fabric flaws, prior repairs, previously damaged garments, or improper care before embroidery. If a garment fails due to a pre-existing condition during embroidery, such failure shall not be considered negligence by byryembroidery.
Machine Malfunction Policy
Although rare, embroidery equipment may experience mechanical failure. If byryembroidery determines that our machine or production process directly caused damage to a customer-supplied item, we will reimburse the customer for the reasonable replacement cost of the damaged item. To qualify: the damage must have been caused by byryembroidery's equipment or production process, the customer must have provided the original product link before production, and the replacement will be based on the original purchase price or current retail price of the same item, whichever is lower, unless otherwise agreed in writing. Our responsibility is limited to the replacement cost of the item itself.
Limitation of Liability for Customer-Supplied Items
Except as expressly stated in the Machine Malfunction Policy above, byryembroidery shall not be liable for sentimental value, collector value, vintage or irreplaceable items, limited-edition merchandise, lost business opportunities, consequential damages, emotional distress, attorney's fees, or incidental damages. Customers are strongly discouraged from submitting irreplaceable, heirloom, one-of-a-kind, or high-value items for embroidery.
Right to Decline Certain Items
byryembroidery reserves the right to decline embroidery on any item that may damage embroidery equipment, produce poor embroidery quality, create unreasonable production risks, be unsuitable for machine embroidery, be excessively worn or damaged, be unclean or unsanitary, or contain hazardous substances. Such determinations are made solely at the discretion of byryembroidery.
Customer Packaging & Shipping
Customers are responsible for safely packaging and shipping customer-supplied items to byryembroidery. Unless otherwise agreed in writing, customers assume the risk of loss or damage during shipment to us, are responsible for all inbound shipping costs, and remain responsible for return shipping costs unless otherwise agreed.
Unclaimed Customer Property
Completed customer-supplied items must be claimed promptly after notification that the order is complete. If an order remains unclaimed for 90 days after the customer has been notified that it is ready for shipment or pickup, and reasonable efforts to contact the customer have been unsuccessful, byryembroidery reserves the right to treat the items as abandoned property to the extent permitted by applicable law. Before taking any action, we will make reasonable attempts to contact the customer using the information provided during the ordering process.
Recommendation Regarding Garment Brands
Although customers may purchase garments from any retailer, byryembroidery may recommend specific brands or products that consistently produce superior embroidery results. Such recommendations are provided as a courtesy and do not constitute a warranty regarding the quality of third-party products.
Our Promise
We understand that when customers trust us with their own garments, they are often sending items that are meaningful or have been carefully selected. We treat every customer-supplied item with the same level of care and attention that we would give to our own belongings. While embroidery always involves some inherent risk, our goal is to minimize that risk through careful preparation, quality equipment, and thoughtful craftsmanship.
6. Intellectual Property, Copyright, Trademarks & Customer Content
Respect for Intellectual Property
byryembroidery respects the intellectual property rights of artists, designers, businesses, and other creators. Customers are solely responsible for ensuring they have the legal right to use any artwork, logos, text, trademarks, photographs, or other materials submitted for embroidery. byryembroidery does not independently verify ownership or licensing of customer-submitted designs.
Customer Representations & Warranties
By submitting artwork or requesting embroidery, you represent and warrant that you own the artwork, or that you have obtained all necessary licenses, permissions, or authorizations to use it — including company logos, school logos, sports team logos, brand trademarks, copyrighted artwork, photographs, character images, digital illustrations, monograms, and custom graphics. You further represent that the requested embroidery will not violate the intellectual property rights of any third party.
Customer Responsibility
The customer accepts full legal responsibility for all submitted designs. byryembroidery assumes that all artwork submitted has been lawfully obtained and authorized for embroidery. We are not responsible for investigating ownership, authenticity, licensing, or copyright status of customer-provided materials.
Indemnification for Intellectual Property Claims
The customer agrees to defend, indemnify, and hold harmless byryembroidery, its owner, employees, contractors, and representatives from any and all claims, lawsuits, damages, losses, costs, expenses, settlements, judgments, or attorneys' fees arising from or related to copyright infringement, trademark infringement, trade dress infringement, patent claims related to submitted artwork, unauthorized logo reproduction, unauthorized commercial use of artwork, or any claim that customer-provided materials violated the rights of another party. This obligation survives completion of the order.
Right to Decline Artwork
byryembroidery reserves the right to refuse any order that, in our sole discretion, appears to infringe another person's intellectual property rights; contains offensive, discriminatory, hateful, or unlawful content; promotes violence or criminal activity; contains sexually explicit material; contains defamatory or harassing content; violates applicable laws or regulations; or could reasonably expose byryembroidery to legal liability. We are under no obligation to explain our decision to decline a design.
No Legal Review
Acceptance of an order does not mean that byryembroidery has reviewed, approved, or confirmed the legality of the submitted artwork. Our acceptance should never be interpreted as legal advice or confirmation that a design may legally be reproduced.
Ownership of Digitized Embroidery Files
Unless expressly agreed otherwise in writing, all embroidery digitizing files (.DST, .PES, .EXP, .VP3, .JEF, .XXX, and any other machine embroidery formats) created by byryembroidery remain the exclusive intellectual property of byryembroidery. Customers purchase the finished embroidered product and/or the embroidery services performed — not ownership of the embroidery file itself. byryembroidery does not provide, sell, license, distribute, or transfer digitized embroidery files created for customer orders unless a separate written licensing agreement specifically authorizes such transfer. This policy helps ensure quality control, protection of our creative work, protection of our production methods, and consistency in future orders.
Portfolio Rights
Unless a customer specifically requests confidentiality before production begins, byryembroidery reserves the right to photograph completed work and use those photographs for legitimate business purposes, including our website, social media, online portfolio, marketing materials, educational content, and product listings. We will make reasonable efforts to avoid displaying personal information such as home addresses, phone numbers, or other sensitive details that may appear on custom projects. Customers requesting privacy for gifts, business launches, weddings, or other confidential projects should notify us before production begins, and we will honor reasonable confidentiality requests whenever possible.
Customer Feedback & Testimonials
If a customer voluntarily submits a review, testimonial, or photograph of a completed order through public channels (such as social media, Google reviews, or messages), byryembroidery may reference or repost that content for promotional purposes, unless the customer requests otherwise. We will not alter customer reviews in a misleading manner.
Business Branding & Website Content
Our business name, logo, branding, website content, product photographs, original embroidery designs, marketing materials, written descriptions, policies, and educational materials are the exclusive property of byryembroidery and may not be copied, reproduced, distributed, or used without prior written permission. Unless otherwise indicated, all content appearing on the byryembroidery website — including text, graphics, images, logos, layouts, photographs, and original design elements — is protected by applicable copyright and intellectual property laws. Users may view this content for personal, non-commercial purposes only.
Custom Designs Created by byryembroidery
When byryembroidery creates an original embroidery design, layout, or artistic composition from a customer's ideas or instructions, the underlying creative work remains the intellectual property of byryembroidery unless otherwise agreed in writing. The customer receives the finished embroidered product but does not automatically receive exclusive ownership of the design or its digital production files.
Reservation of Rights
Any rights not expressly granted to customers under these Terms are reserved by byryembroidery.

7. Shipping, Delivery, Risk of Loss & Order Fulfillment
Shipping Availability
At this time, byryembroidery ships within the United States only. We reserve the right to expand or limit our shipping destinations at any time. Orders requesting shipment outside the United States may be declined unless otherwise agreed in writing.
Processing Time
Our standard production timeline is approximately 2 weeks. Design proofs are typically delivered within 1–3 business days after all required order information has been received. Production begins only after full payment has been received and the customer has approved the design proof (when applicable). Production timelines are estimates only and may change due to order volume, design complexity, material availability, equipment maintenance, holidays, or other unforeseen circumstances.
Shipping Carriers & Charges
byryembroidery may use one or more shipping carriers, including USPS, UPS, FedEx, or other reputable carriers. The selected carrier is determined at our discretion unless the customer requests and pays for a specific shipping service. Customers are responsible for all shipping charges unless otherwise stated in writing, which may include carrier postage, packaging materials, shipping supplies, insurance (when purchased), and special handling requested by the customer. Shipping costs are calculated separately from product pricing unless expressly included in a quote.
Rush Shipping vs. Rush Production
Rush production and expedited shipping are separate services. A rush production fee prioritizes the order in our production schedule but does not guarantee carrier delivery times. Likewise, selecting expedited shipping does not shorten the time required to design, digitize, or embroider an order. To receive an order as quickly as possible, customers may need to purchase both rush production and expedited shipping, subject to availability.
Shipping Address Accuracy
Customers are responsible for providing a complete and accurate shipping address. byryembroidery is not responsible for delays, additional shipping costs, lost packages, or returned shipments resulting from incorrect addresses, missing apartment or unit numbers, typographical errors, outdated addresses, or failure to accept delivery. If an order is returned to us due to an address error provided by the customer, the customer is responsible for paying the cost of reshipping the order.
Tracking & Risk of Loss
When available, tracking information will be provided after the order has shipped. Customers are responsible for monitoring tracking updates and contacting the shipping carrier regarding delivery issues once the package has entered the carrier's possession. Ownership of the completed order and the risk of loss or damage transfer to the customer when the package is delivered to the shipping carrier. After shipment, delays, damage, or loss caused by the carrier are generally outside the control of byryembroidery. We will make reasonable efforts to assist customers in resolving carrier claims, but we cannot guarantee the outcome of those claims.
Delivery Delays
Estimated delivery dates are provided by shipping carriers and are not guaranteed by byryembroidery. We are not responsible for delays resulting from weather, natural disasters, carrier operational issues, labor strikes, customs inspections (if international shipping is offered in the future), transportation disruptions, high shipping volume, or other events beyond our reasonable control. Such delays do not entitle the customer to a refund of production charges.
Lost or Damaged Packages
If a package is marked as delivered by the carrier but cannot be located, customers should verify the shipping address, check with household members or neighbors, contact the shipping carrier, and notify byryembroidery. While we will reasonably assist in locating the shipment, we cannot guarantee reimbursement for packages confirmed as delivered by the carrier.
If an order arrives visibly damaged during shipping, customers should retain all original packaging, photograph the damaged package and its contents before use, notify byryembroidery within 5 calendar days of delivery, and cooperate with any insurance or carrier claim process. Failure to preserve evidence of shipping damage may limit available remedies.
Returned or Refused Packages
Packages returned due to incorrect customer addresses, failure to claim the shipment, refused delivery, or unsuccessful delivery attempts may be reshipped once the customer pays any additional shipping charges. If the customer no longer wishes to receive the order after it has been produced, the order remains subject to our Return & Refund policy below. For larger or complex orders, byryembroidery reserves the right to ship items in multiple packages if doing so improves efficiency or protects the products during transit; customers will be notified when practical.
Pickup Orders
If local pickup is offered, customers will receive instructions after their order is complete. Orders not picked up within the applicable holding period may be considered abandoned property as described elsewhere in these Terms.
Force Majeure
byryembroidery shall not be liable for delays or failure to perform obligations caused by events beyond our reasonable control, including severe weather, natural disasters, fire, flood, power or internet outages, government actions, public health emergencies, supply chain disruptions, labor shortages, shipping carrier interruptions, equipment failure despite reasonable maintenance, or other unforeseeable circumstances. In such cases, production and delivery timelines will be extended for the duration of the disruption.
Our Shipping Commitment
Every completed order is carefully inspected, packaged, and prepared for shipment with the goal of ensuring it arrives safely and in excellent condition. We are committed to clear communication throughout the fulfillment process and will make reasonable efforts to assist customers if shipping issues arise.
8. Returns, Refunds, Cancellations & Order Changes
Custom Nature of Our Products
Every order created by byryembroidery is made specifically for an individual customer. Because our products are custom-made and often personalized, they cannot be restocked or resold after production. For this reason, our return and cancellation policies differ from those of traditional retail stores.
No Returns
Unless otherwise required by applicable law or expressly provided in these Terms, all sales are final. byryembroidery does not accept returns or exchanges for personalized items, monogrammed items, custom embroidery, customer-supplied garments, digitized designs, made-to-order products, or sale/clearance items. Customers acknowledge and agree to this policy before placing an order.
No Refunds After Production Begins
Production begins only after full payment has been received and the customer has approved the proof, when applicable. Once production has started, orders cannot be canceled and payments are non-refundable, since production costs, materials, and labor have already been committed to the order.
Cancellation & Changes Before Production
If a customer requests cancellation before production begins, byryembroidery may approve the cancellation at its sole discretion. If work has already been performed (such as artwork preparation, consultations, or digitizing), byryembroidery reserves the right to retain fees associated with those completed services; any remaining eligible amount may be refunded using the original payment method.
Customers may also request changes before production begins — a different garment, updated personalization, new thread colors, different sizing, or additional quantities. Approval of requested changes is at the sole discretion of byryembroidery, and approved changes may result in additional charges, revised production timelines, updated proofs, or new quotes.
No Changes After Production Begins
Once embroidery production has started, changes cannot be made to names, initials, dates, fonts, thread colors, placement, artwork, garments, or quantities. This policy protects production quality and prevents unnecessary waste of materials and labor.
Errors Made by byryembroidery
If byryembroidery determines that we made a production error that differs materially from the customer's approved proof or written order specifications, we may, at our sole discretion, repair the item, replace the item, or issue a partial or full refund. The selected remedy will depend on the nature of the issue and whether it can reasonably be corrected.
Customer Errors
byryembroidery is not responsible for errors resulting from information supplied or approved by the customer — including misspelled names, incorrect initials or dates, wrong garment size or color selection, or approved placement the customer later dislikes. Once approved by the customer, these items become part of the authorized production instructions. Proof approval confirms that the customer accepts the layout, placement, personalization, colors, fonts, and design size — failure to review a proof carefully does not create an obligation for byryembroidery to replace or refund an order.
Color, Placement & Stitch Variations
Due to the handcrafted nature of embroidery, slight placement differences, minor color variations, thread sheen differences, appropriate fabric puckering, slight differences from digital proofs, and minor stitch variations are not considered defects. These characteristics are normal and expected in custom embroidery.
Customer-Supplied Items & Shipping Issues
Policies regarding customer-supplied garments are governed by Section 5 above; except where expressly stated in the Machine Malfunction Policy, customer-supplied items are embroidered at the customer's risk. Shipping-related concerns are governed by Section 7 above — byryembroidery is not responsible for carrier delays, weather delays, lost packages after confirmed carrier delivery, or incorrect addresses supplied by the customer, though we will make reasonable efforts to assist customers in resolving shipping issues.
Chargebacks & Refused Shipments
Customers agree to contact byryembroidery before initiating a chargeback or payment dispute. Submitting a payment dispute after receiving an approved proof and custom production services may constitute a breach of these Terms; byryembroidery reserves the right to present documentation supporting the transaction, including order confirmations, payment records, proof approvals, email correspondence, shipping documentation, and delivery confirmations. If a customer refuses delivery of a completed custom order without prior written agreement, the order remains subject to these Terms, and shipping charges and any additional costs incurred due to the refusal may remain the customer's responsibility.
Goodwill Exceptions
Although our policies are designed to be applied consistently, byryembroidery may occasionally offer accommodations as a gesture of customer service — such as minor repairs, courtesy replacements, store credit, or partial refunds. Any such accommodation is voluntary and does not establish a precedent or obligate byryembroidery to provide the same accommodation in future situations.
Limitation on Refunds
Any approved refund will be limited to the amount actually paid by the customer for the affected product or service. Under no circumstances shall byryembroidery be liable for lost profits, lost business opportunities, consequential or incidental damages, emotional distress, attorney's fees, travel expenses, or third-party costs, unless required by applicable law.

9. Limitation of Liability, Disclaimers & Legal Protections
Limitation of Liability
To the fullest extent permitted by applicable law, the total liability of byryembroidery arising out of or relating to any order, product, service, or these Terms shall not exceed the amount actually paid by the customer for the specific order giving rise to the claim. This limitation applies regardless of the legal theory asserted, including contract, tort (including negligence), strict liability, or otherwise.
No Liability for Indirect or Consequential Damages
To the fullest extent permitted by law, byryembroidery shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost business opportunities, loss of goodwill, loss of anticipated savings, loss of use, emotional distress, reputational harm, attorney's fees, travel or event expenses, or substitute product costs obtained from another vendor, even if we were advised that such damages were possible.
Maximum Recovery
If byryembroidery is found legally responsible for a claim, the customer's exclusive remedy shall be limited to repair of the affected item, replacement of the affected item, or refund of the purchase price paid for the affected product or service, as determined by byryembroidery in its reasonable discretion. No other monetary damages shall be available except where required by applicable law.
No Guarantee of Exact Results
Embroidery is a handcrafted process involving fabric, thread, stabilizers, machine settings, and human judgment. Accordingly, byryembroidery does not guarantee exact thread color matches, identical placement across every item, perfect duplication of previous orders, exact reproduction of digital artwork or of colors displayed on electronic devices, or exact stitch counts or densities. Minor differences are inherent in the embroidery process and are not considered defects.
Website Information
We strive to ensure that all information on our website is accurate and current. However, we do not guarantee that product descriptions are error-free, that pricing is free from typographical errors, that colors displayed on electronic devices accurately reflect thread colors, or that all products remain continuously available. We reserve the right to correct errors and update information at any time without prior notice.
Third-Party Products and Services
Our website or communications may reference or link to third-party products, brands, retailers, or websites. byryembroidery is not responsible for the quality of third-party products, third-party warranties, third-party shipping or privacy practices, third-party website content, or retailer inventory or pricing. Customer-Supplied Garments
As detailed in Section 5, embroidery performed on customer-supplied items involves inherent risks. Except where damage is directly caused by a machine malfunction or production error for which byryembroidery has accepted responsibility under these Terms, customers assume the risks associated with providing their own garments for embroidery.
Force Majeure
byryembroidery shall not be liable for delays or failures resulting from events beyond our reasonable control, including natural disasters, floods, fires, power or internet outages, equipment failure despite reasonable maintenance, supplier shortages, shipping carrier disruptions, government actions, public health emergencies, labor disputes, severe weather, or any other event that could not reasonably have been anticipated or prevented. In such circumstances, affected deadlines shall be extended for the duration of the event.
Customer's Duty to Inspect
Customers are responsible for inspecting their order promptly upon receipt. Any concerns regarding production quality should be reported as soon as reasonably possible after delivery. Prompt notification helps us investigate and, where appropriate, provide an available remedy.
No Professional Advice
Information provided on our website, through email, social media, or in customer communications is for general informational purposes only. Nothing provided by byryembroidery constitutes legal, tax, financial, or professional advice. Customers should consult appropriate professionals regarding matters outside the scope of our embroidery services.
Indemnification
Customers agree to defend, indemnify, and hold harmless byryembroidery, its owner, agents, contractors, and representatives from any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable attorneys' fees where recoverable by law) arising out of or related to customer-provided content or artwork; violation of these Terms; infringement of another person's intellectual property rights; misuse of products after delivery; or violation of applicable laws by the customer. This obligation survives completion of the order.
Survival
Provisions relating to Intellectual Property, Payment Obligations, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution, and any provisions that by their nature are intended to survive, shall survive the completion, cancellation, or termination of any order.
Severability & No Waiver
If any provision of these Terms is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect; any invalid provision shall be interpreted, to the extent possible, in a manner that most closely reflects its original intent while remaining enforceable under applicable law. Failure by byryembroidery to enforce any provision of these Terms shall not constitute a waiver of that provision or of any other rights available under these Terms or applicable law.
Entire Agreement
These Terms, together with any policies expressly incorporated by reference, constitute the complete agreement between the customer and byryembroidery regarding the purchase of products and services, and supersede all prior discussions, proposals, representations, or agreements relating to the same subject matter.
Our Commitment to Fairness
While these Terms are intended to protect byryembroidery from unreasonable legal exposure, they are equally intended to establish clear expectations for customers. We believe transparency builds trust, and our goal is to resolve concerns fairly, professionally, and in good faith whenever possible.
10. Governing Law, Dispute Resolution, Contact Information & General Provisions
Governing Law
These Terms & Conditions, together with any dispute arising out of or relating to your use of the byryembroidery website, products, or services, shall be governed by and interpreted in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Nothing in these Terms limits any consumer rights that cannot legally be waived under applicable law.
Good Faith Resolution
byryembroidery values open communication and believes that most concerns can be resolved without formal legal action. If a dispute arises, both the customer and byryembroidery agree to first make a good faith effort to resolve the matter through direct written communication. The customer agrees to contact byryembroidery using the contact information below and allow up to 30 calendar days for a response and reasonable efforts toward resolution before initiating legal proceedings, except where immediate legal action is required by law. Nothing in this section prevents either party from seeking emergency legal relief where permitted.
Venue and Jurisdiction
To the extent permitted by applicable law, any legal action arising out of or relating to these Terms or the products and services provided by byryembroidery shall be brought exclusively in the appropriate state or federal court located within the Commonwealth of Massachusetts. Both parties consent to the jurisdiction of those courts.
